By February 2019, the Law on Access to Information (LAI) had been passed by the National Assembly for nearly 4 years and had been in effect for more than 1.5 years. The Law holds a significant role in realizing Vietnamese citizens’ rights of access to information, which is stated in Article 25 of the 2013 Constitution.
In the period from November 2018 to February 2019, with the financial support of the European Union, 05 organizations and networks including Center for Education Promotion and Empowerment of Women (CEPEW), Vietnam Mining Coalition (VMC), Forest Land Alliance (FORLAND), Vietnam Clean Water Alliance (VCWA) and Oxfam in Vietnam have conducted the initial assessment (also called the first evaluation) of the implementation of the LAI.
The first evaluation focused on assessing two main points:
The compatibility between the LAI, as well as related legal transactions, and international conventions on human rights and anti-corruption, of which Vietnam is a country member.
The implementation of the LAI in some ministries, departments and Ha Giang Province, Quang Binh Province, and Da Nang City.
From November 2019 to February 2020, the EU continued its funding for the 05 organizations and networks above, along with the Network of Social Organizations in the Northern Mountainous Region (NORTHNET) and Care International in Vietnam, to carry out the second evaluation of the LAI.
The objective of the second evaluation is to examine the push factors, achieved results, the gaps in the distribution of guiding documents and the organization and implementation processes of the LAI. From there, further recommendations are expected for different levels and departments to promote the effective implementation of the Law.
Tính đến tháng 2/2019, Luật Tiếp cận thông tin (TCTT) đã được Quốc hội thông qua gần 4 năm và có hiệu lực thực thi hơn 1,5 năm. Luật TCTT có ý nghĩa rất quan trọng trong việc cụ thể hóa quyền tiếp cận thông tin của công dân được quy định tại Điều 25 Hiến pháp 2013.
Trong giai đoạn từ tháng 11/2018 đến tháng 2/2019, với sự hỗ trợ tài chính của Liên minh Châu Âu (EU), năm tổ chức và mạng lưới gồm Trung tâm Thúc đẩy giáo dục và nâng cao năng lực phụ nữ (CEPEW), Liên minh khoáng sản (LMKS), Liên minh đất rừng (FORLAND), Liên minh nước sạch (LMNS) và tổ chức Oxfam tại Việt Nam đã thực hiện đánh giá ban đầu việc thực thi Luật TCTT (hay còn gọi là đánh giá lần thứ nhất)
Đánh giá lần thứ nhất tập trung vào đánh giá hai vấn đề chính.
Sự tương thích giữa Luật TCTT và các văn bản quy phạm pháp luật (VBQPPL) liên quan đến quyền TCTT với các công ước quốc tế về nhân quyền và phòng, chống tham nhũng mà Việt Nam là quốc gia thành viên.
Việc thực thi Luật TCTT của một số bộ, ngành và các tỉnh Hà Giang, Quảng Bình và Thành phố Đà Nẵng.
Trong giai đoạn từ tháng 11/2019 đến tháng 2/2020, EU tiếp tục hỗ trợ để năm tổ chức, mạng lưới kể trên cùng với Mạng lưới các tổ chức xã hội khu vực miền núi phía Bắc (NORTHNET) và tổ chức CARE quốc tế tại Việt Nam thực hiện đánh giá việc thực thi Luật TCTT lần thứ hai.
Mục tiêu của đánh giá lần thứ hai nhằm tìm ra các yếu tố thúc đẩy, kết quả đạt được, những khoảng trống trong việc ban hành các văn bản hướng dẫn và quá trình tổ chức thực hiện Luật TCTT. Từ đó, tiếp tục đưa ra những khuyến nghị cho các cấp, các ngành liên quan nhằm thúc đẩy thực thi một cách hiệu quả hơn Luật TCTT trong thời gian tới.
